breaking news going on in east san jose right now. you are looking at live pictures from our chopper as police have been in a standoff with a gunman for three hours now. police say he opened fire at a check cashing facility before jumping roof to roof, trying to escape police. we are now hearing reports officers may have taken that gunman into custody. good morning, everybody, thank you very much for joining us. i'm jon kelley. marla tellez has the day off. san jose police are home located on cinderella lane, a few blocks away from story road. nbc bay area's bob redell with the first reporter on scene. he has been talking to neighbors all morning long. bob, right now, starting to hear that tense situation may soon be over, correct?

>> yes, just a few seconds ago to my right, an ambulance just left the scene. we believe that the suspect is tt being atu)tjt treated for an unknown injury. we also spoke with officers who have been guarding the perimeter here at sunset and cinderella and teill there might be a secod suspect, something that the man in custody indicated to police, they are just trying to confirm. police arrested this man 40 minutes ago after he tried elude police for a couple of hours. he's young man in his 20s but for i'lhim, proved very difficu to elude police, considering there were roughly 100 officers surrounding this area, woman is their guns drawn. when san jose's version of s.w.a.t. arrived they can went door to door, house to house, until they found him. took roughly 20 minutes and we are not sure what happened as far as he was arrested. did he surrender or was he taken

with force in the man they arrested, as i mentioned a young man in his 20s, wanted for shooting up a check cashing facility during an attempted robbery on story and diana. 7:45 this morning. ran from that scene to this neighborhood, cinderella way, a block or two away from the initial crime scene. does not seem like he had much of a get away plan. seems like based on talking to people who live around here, he was in a frantic attempt to escape. this was a get away that intersected with his life with the life of a woman who was asleep in her home here on cinderella way when this man entered her house. >> get up. get up, three times. >> i told him to get out, he said, okay, okay, i get out. that's what he told me. >> what were you doing at the time? >> get out. i'm trying to fight him, because he was inside now. >> did you hit him? >> no. >> did he hit you? >> no. >> and he listened? >> he listened and he get out.

>> on the roof, on top of the roof. i don't know now. >> reporter: this video we are showing you right now gives you a sense of just how secure the police were trying to keep this neighborhood when -- before they arrested this man h you can see they were having people who were trying to leave pop their trunks to make sure he wasn't hiding inside. again, police tell us that this suspect has been arrested. we did not hear shots fired during the arrest, not sure what kind of incident took place if there was a struggle or a surrender. the only time shots were fired, according to police you was during the shoot-up at the check cashing facility. during that attempted robbery there were no injuries. trying to verify if there is a second suspect hiding behind me in the neighborhood on cinderella way. bob recommend, nbc bay area news. >> hang tight in case anything happens. we will check back if it does. from the south bay, learning

new detail about a frightening attack, a man assaulted a woman a couple blocks from santa clara university on the corner of lexington and main streets. investigators trying to figure out if her attacker, a man, used some sort of a weapon. now the victim was able to get away, we are happy to report that a police dog was able to track that suspect's scent but ended up losing that scent on campus. we want to get you updated on an attack this one happening at a different south bay university. police at south san jose state telling us they have arrested a man in connection to an on-campus beating, sending a 22-year-old man to the hospital. police believe the atendering a the victim knew one another. on tuesday night, police say the two men apparently got into some kind of6%z fight and the attack ended up slamming the victim's head right into the concrete numerous times. the victim was then taken to the hospital suffering non-life threatening injuries. well, a very emotional day in court for one of the women held captive by a cleveland man for nearly ten years. this marks the very first time

michelle knight has been seen publicly since her rescue several months ago. her very brave statements coming during sentencing for ariel admitting that, yes, he has a long list of issues. nbc's jay gray has more from cleveland. >> reporter: as the hearing began, ariel castro entered the courtroom alert and with his head up, a much different demeanor than in previous court appearances. as the proceeding unfolded, prosecutors prevented evidence that showed the horrors the women endured in castro's house. a scale model of that home, photos of the women looking pale and gaunt and the kahnes used to restrain them, but the most powerful evidence came from the victim's impact statements, which began with the cousin of gina dejesus reading a letter. >> today is the last day we want to think or talk about this. these events will not [ inaudible ] our hearts. >> reporter: next, it was the sister of amanda berry. >> she is strong, beautiful, inside and out and is doing

better every day. >> reporter: an emotional michelle knight hugged her family before address the court and facing castro for the first time since her escape. >> i will live on. you will die a little every day. as you think about the 11 years of atrocities you are inflicted on us. >> reporter: next, ariel castro made a statement where he blamed an addiction to pornography for his actions. >> i am just sick. i have an addiction. >> reporter: testimony of daily beat eggs and other relentless physical, mental and emotional abuse were outlined by investigators, even though the sentence for castro is already known. in a plea deal, castro will now spend the rest of his life in prison, as his victims now try to move forward after nearly a decade in captivity. at least twice during his sentencing, castro interrupted the judge who, at one point, told castro "you have extreme

narcissism." jay gray, nbc news, cleveland. >> all right, jay gray, thank you very much. closer to home, a critical day in the push to avoid another b.a.r.t. strike if negotiations between b.a.r.t. and its labor union don't progress, workers all set to issue that 72-hour strike notice some time tonight. notice bay area's christie smith is live in oakland right now, where we just heard from the unions. christie, good morning. >> reporter: good morning to you. that's right. one of b.a.r.t.'s unions wrapped up a press briefing a couple of minutes ago saying they have had problems with b.a.r.t.'s chief negotiator in the past. they say they do not like his tactics. now, negotiations expected to resume today at noon. meantime, in just six hours, the unions plus supporters plan to have a big rally here at the plaza downtown oakland, saying no more concessions, no more give backs, it's a march to b.a.r.t. headquarters. today, other chapter presidents fle flew in from places across the

country said they are not a friend to labor. b.a.r.t. trains could be stopped rolling again next week, causing gridlock once again in the bay area. the ral think evening expected to include several unions supporting b.a.r.t. workers. and police say they have word that occupy oakland may come join in as well. they say rally organizers have been very cooperative, keep an eye out for splinter groups may cause trouble. >> not stand by and let someone come in and erode what we have built up as a strong labor community that is fighting for the wages and the benefits for workers that are unionized as well as workers that are not. >> we are receiving information that occupy and trayvon martin protesters plan to meet with the already organized union who plans to do their own rally and have their own messaging that

they want to send. so we have received information and again, we are prepared. we have increased staffing. you will see increased police presence. >> reporter: sm;oakland police they are here and will be to help facilitate a peaceful march, but they have rented, this video you are seeing a is what it looks like from the oakland police department, represented a number of vans to help police move around the crowd this morning. the march starts here at 5:00. the rally starts at 5:00, the march leaves here at 6:00 and heading over to b.a.r.t. headquarters near lake merit. live in oakland, christie smith, nbc bay area news. >> christie, thank you very much. during the last strike, the fer police packed out there, why the san francisco bay ferry is now getting its staff and crew all ready to brace for this one. it will expand the number of boats in operation from eight to 12 or 13. it will evenjgn borrow two from golden gate ferry. the boat also leave earlier so they are ready for that. now, if that strike does happen,

snowden's lawyer that snowden was issued temporary asylum in russia. when asked where snowden was going, he said he would not say, citing security reasons. now, a top russian official said that the snowden incident was insignificant, from the kremlin's point of view, and he hope it is would not damage relations already strained with the united states. washington is apparently crafting a response and certainly, this is going to come as discouraging news. but it might mean that all bets are off for a key summit meeting to take place here in moscow in early september, just before the g-20 between president putin and obama. i'm jim maceda, innocennbc news reporting from moscow. >> thank you very much, jim. a south bay mayor organized a blood drive but not allowed to donate himself. tell you about the ban he is trying to overturn next. harvest coming early this year.

we have an update now to the breaking news we brought you at the top of the show, san jose police have a neighborhood in east san jose shut down as they look for as possible suspect there just located a few blocks away from story road. nbc bay area's bob redell is

there right now he has a live update. what is the latest? >> reporter: good morning to you you jon, evenkrjñ though the cr scene tape is still up behind me here on cinderella way at the corner of sunset, that neighborhood is back open. we just heard officers allowing residents to walk back in to get back to their homes. so even though the tape's up, the neighborhood is open. that suspect was taken away in an ambulance, roughly about ten minutes ago for an unknown é@ injury. there was a squad car escorting that ambulance to regional medical center where that suspect is going to be treated. that man -- young man in his 20s was arrested around 10:20 this morning, this after earlier this morning, shotm9ñ up a cash checg store at story and diana, a couple blocks from here. still see law enforcement here in this neighborhood. they were looking for as point second suspect, the fact they are letting people back into the neighborhood indicates that they have given up on the search, but

came to the conclusion there was never a second suspect, there was a man arrested that indicated to them that they had an accomplice. they are also looking for the gun, quite possible the gun they used in that attempted robbery has not yet been found. wasn't on them him and possibly still looking for that he came over to this neighborhood in an attempt to get away after shooting up that check cashing facility, quarter to eight this morning. officers descended upon this neighborhood, one officer guarding the perimeter said roughly 100 colleagues here and had merge, san jose's version of s.w.a.t. when they arrived on the scene at 10:00 this morning, they started going house to house, yard to yard around within about 20 minutes, they were able to find this man and arrest him. so, no one was injured, except for the suspect, who was taken away in the hospital. no one was injured during the shooting up of that check cashing facility this morning. live near san jose, bob red he will, nbc bay area news. >> bob redell on the scene all morning long, great stuff. appreciate the updates, bob. thank you very much. a u.s. soldier who died in the korean war over 50 years ago

will now be buried right here in the bay area that will be happening today. remains of sergeant first class joeself steinberg arriving by plane in san jose on tuesday. steinberg was captured during the korean war and held in a p.o.w. camp until his death in 1951. his remain recently identified through dna testing. steinberg is now being buried at golden gate national cemetery. that is in san bruno, where his three brothers are also buried. the fight against the deadly west nile virus ramping up today in the south bay, it will happen tonight, the second time in less than a week, vector control crews will be out in force in north san jose fogging for mosquitoes. of course that? is a defense move, scheduled to start at 11:00 tonight, weather permitting it will take several hours. the vector control district says west nile is very active in the county this year. officials warning people to protect themselves to.ljñ tritet

they can for mosquito bits and eliminate standing water on their properties. the host of a south bay blood drive denied the opportunity to take part in his very ow@g event. campbell mayor evan lo was deferred or banned from giving blood yesterday because of the fact he is gay. the fda has imposed a lifetime ban on gay donors since 1983 in response to the aids scare. mayor lo, calling it discrimination, and he is now call october fda to review the three decade-old beenan and rep it. >> disappointed i'm not able to donate blood. certainly the criteria that was determined to figure out whether or not i would be an eligible candidate is insulting. one could lie on the form and test the blood. >> in response, the red cross says it is following the fda's lead and the red cross also says there are other way the gay community can support blood donations, like sponsoring a

drive. guess what? it is the beginning of august, also the very start of the wine harvest in napa valley. a lot of happy people out there to get those grapes going. our chopper was overhead this morning as grape picking started at mum napa. this is one of california's top producers of the always popular sparkling wine, sparkling wine grapes, of course, they are picked earlier than still wine grapes, always like to educate the public out there. growers say a dry spring led to an early harvest. but it looks like pretty good weather coming up to get those grapes into the bottles. >> cheers to that dealers that >> cheers to all of us. >> you know what? they have some great weather out there to do that picking. i always wanted to stomp the grapes. >> probably arrange that. do "i love lucy." >> definitely be that way. live look outside, really cool weather to show you, this is the bay bridge, where the clouds are right now. show you the golden gate bridge, crystal clear aboutï$p&l day

finally this morning there is something smelly happening on the uc santa barbara campus. when i say smelly, real funky, thanks to a flower in bloom there. this is a very stinky flower. it is called the titan arum, yeah, a huge perennial, i guess, some refer to it as the corpse flower. doesn't sound pleasant, does it? >> no. >> it is known for being extremely arrextreme ly aromatic. these are reach up to ten feet in height and very native to rain forests near the equator. not a real pleasant flower to look at either. >> maybe put some glass around it, contain that stench. >> do something like that i don't know why you would want to grow that, a perennial just funky, not in a good way. 11:27. have a great day. see you tomorrow. thanks for joining us. check us out online, nbcbayarea.com.
